Legal Law

The subtle nuances of the publishing process

Contrary to popular belief, a legal run-in is not just the dramatic confrontation between the prosecutor and the defendant in court. There is a lot of paperwork involved. Now, when you hire a lawyer or legal advisor specializing in litigation cases, you often tend to overlook the sublime beauty of service of process. In the legal world, he is treated as an underdog, mainly because no one seems to realize his paramount importance. Let’s just say: the experience of legal litigation would be completely different had it not been for the existence of the humble practice. But who is a process server, you might ask.

A process server is a legal staff employed to deliver important legal documents such as legal demands, subpoenas, legal petitions, notices, writs to recipients. Although this may seem like a regular dealer, it is far from it. You have to complete your work following to the letter these criteria of legal discipline. You must either provide such documents to the intended recipient personally or you must sub-deliver the documents to someone willing to receive the documents on his or her behalf.

The work of this practice, however, does not end there. He is expected to bring proof of successful delivery of the papers. This is accomplished by exchanging a document called Proof of Delivery. This notarial document is an affidavit certifying the receipt of the documents by the requested owners. For many people, this process is extremely confusing, but the work of this method cannot be ignored under any circumstances.

Process servers are people who serve the legal system only through this job. For this reason they receive a healthy remuneration for the number of papers served. This can range from $15 to as much as $100 for each item. However, such wages are entirely dependent on the duration of the job, the complexity involved, and the organization that hires you to do your job.

The average time a job takes can range from half an hour to two hours. For homeowners looking to earn some extra money, even a sum like $50 is enough to get you through the day. What’s more, it’s easy to become a process server. This job does not need fancy qualifications. The only condition to hire is that you have no criminal record of any kind. However, experience in the legal field will be considered an added advantage in this line of work.

This line of work, like all others, has its ups and downs. Process servers are plagued by slippery candidates more often than expected. To avoid formal litigation, some people deliberately avoid meeting with their process servers to accept documents sent by the court. This gives the added responsibility of hunting down the intended recipient.

For a process server, this job is as exciting as it gets. It’s a thrilling chase in its own right, but it also involves a degree of danger.
